Terms of Service

These Terms govern your use of shortstayinla.com and any informational tool we publish, including the earnings calculator and lead form. They do not govern the management agreement signed by owners whose homes we manage. That agreement is a separate document.

1. Acceptance

By visiting or using shortstayinla.com (the “Site”), you agree to these Terms of Service. If you do not agree, do not use the Site. The Site is operated by [ENTITY: Short Stay in LA, LLC, to confirm] (“Short Stay in LA,” “we,” “us,” “our”).

Important: Binding Arbitration and Class-Action Waiver

Section 13 below requires that disputes between you and Short Stay in LA be resolved by binding individual arbitration with JAMS and waives your right to participate in a class action. You may opt out of arbitration within 30 days of first accepting these Terms by emailing legal@shortstayinla.com with the subject line “Arbitration Opt-Out.” Read Section 13 carefully.

2. Permitted Use

We grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Site for your personal, non-commercial purpose of evaluating our property management service. All other use requires our prior written consent.

3. Prohibited Use

You agree not to:

  • scrape, crawl, mirror, or systematically copy any portion of the Site;
  • probe, scan, or test the vulnerability of any system or network;
  • circumvent or attempt to circumvent any rate limit, honeypot, or security control;
  • submit false, misleading, or fraudulent information through any form;
  • submit information that belongs to another person without that person’s consent;
  • use the Site to send unlawful, harassing, defamatory, infringing, or obscene content;
  • upload or transmit any virus, worm, or other malicious code;
  • use the Site to violate any law, including fair housing, anti-discrimination, or tax laws;
  • resell, sublicense, or commercially exploit any part of the Site or its content.

4. Accounts

The Site does not require an account for general browsing. If we later offer an account-based portal, you are responsible for keeping your credentials confidential and for every action taken under your account. Notify us at support@shortstayinla.com if you suspect unauthorized use.

5. User Content

You retain ownership of the information you submit through our lead form, calculator, or any other input. By submitting that information, you grant Short Stay in LA a worldwide, royalty-free, non-exclusive license to use it for the purpose of responding to your inquiry, evaluating your property, and providing or marketing our services to you. You represent that you have the right to submit that information and that submitting it does not violate any law or any third party’s rights.

6. Intellectual Property

The text, layout, design, code, logos, and original photography on the Site are the property of Short Stay in LA or its licensors and are protected by United States and international copyright, trademark, and other laws. “Short Stay in LA” and the wordmark are trademarks of [ENTITY: Short Stay in LA, LLC, to confirm]. All other marks are the property of their respective owners. Nothing on the Site grants you a license to any trademark, trade dress, or trade name.

7. Third-Party Services

The Site may link to or embed services we do not control, including Google Maps, payment processors, listing platforms, analytics providers, and advertising networks. We are not responsible for any third party’s content, terms, privacy practices, or availability. Use of any third-party service is at your own risk and subject to that service’s terms.

8. Electronic Communications

By providing your email address or phone number, you consent to receive communications from us electronically. We will send transactional messages related to your inquiry, your calculator estimate, and any property management discussion you initiate. Marketing emails and SMS messages require separate consent and can be revoked at any time per our Email Marketing Disclosure and SMS Terms.

9. No Regulatory, Tax, or Legal Advice

Material on the Site about the Los Angeles Home-Sharing Ordinance, the Beverly Hills short-term rental ban, the Santa Monica RBOA, the Malibu and Los Angeles County unincorporated rules, the Pasadena and Long Beach ordinances, transient occupancy tax, federal or California fair housing law, the California Real Estate Law, or any other regulation is a plain-English summary as of 2026. It is not legal, tax, accounting, investment, or real-estate advice. Rules change. If you need a definitive ruling for your specific property, consult a California-licensed attorney, CPA, or [LICENSING: BROKER ARRANGEMENT TO CONFIRM] licensed under the California Department of Real Estate.

10. Disclaimer of Warranties

THE SITE AND ALL CONTENT ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, SHORT STAY IN LA DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, AND UNINTERRUPTED AVAILABILITY. We do not warrant that the earnings calculator output, market data, or compliance summaries are accurate, complete, current, or applicable to your property. See our Calculator Disclaimer and Earnings Disclaimer.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, SHORT STAY IN LA AND ITS OFFICERS, MEMBERS, EMPLOYEES, CONTRACTORS, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES; FOR LOST PROFITS, REVENUE, GOODWILL, DATA, OR BOOKINGS; OR FOR THE COST OF SUBSTITUTE SERVICES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL CUMULATIVE LIABILITY UNDER OR RELATED TO THESE TERMS IS LIMITED TO THE GREATER OF (A) ONE HUNDRED U.S. DOLLARS ($100) OR (B) THE FEES YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR THE LIMITATION OF CERTAIN DAMAGES; IN THOSE JURISDICTIONS THE EXCLUSIONS AND LIMITATIONS ABOVE APPLY TO THE FULLEST EXTENT PERMITTED BY LAW.

12. Indemnification

You will defend, indemnify, and hold harmless Short Stay in LA and its officers, members, employees, contractors, and agents from and against any claim, demand, loss, liability, judgment, settlement, fine, cost, or expense (including reasonable attorneys’ fees) arising out of (a) your use of the Site, (b) your breach of these Terms, (c) information you submitted that was false, infringing, or not yours to submit, or (d) your violation of any law or any third party’s rights.

13. Arbitration and Class-Action Waiver

Please read this section carefully. It affects your legal rights.

You and Short Stay in LA agree that any dispute, claim, or controversy arising out of or relating to the Site, these Terms, or any service we offer (a “Dispute”) will be resolved by binding individual arbitration administered by JAMS under its Streamlined Arbitration Rules and Procedures then in effect, except as modified by this Section. The arbitration will be conducted in Los Angeles County, California, before a single neutral arbitrator. Judgment on the award may be entered in any court of competent jurisdiction.

Class-action waiver. You and Short Stay in LA agree that each may bring claims against the other only in your or its individual capacity, and not as a plaintiff or class member in any purported class, collective, or representative proceeding. The arbitrator may not consolidate the claims of more than one person and may not preside over any form of representative or class proceeding. Notwithstanding any provision of the JAMS rules to the contrary, only a court (and not the arbitrator) has authority to decide whether this waiver is enforceable, and if any portion of this waiver is found unenforceable as to a claim for public injunctive relief, that claim will be severed and litigated in court while all other claims continue in arbitration.

30-day opt-out. You may opt out of this Section by emailing legal@shortstayinla.com with the subject line “Arbitration Opt-Out” within thirty (30) days of your first acceptance of these Terms. Your opt-out must include your full name, the email address you used on the Site, your mailing address, and a clear statement that you opt out of the arbitration agreement. Opt-out is the only way to preserve your right to litigate in court (subject to the small-claims carve-out below).

Federal Arbitration Act. This arbitration agreement affects interstate commerce and is governed by the Federal Arbitration Act, 9 U.S.C. § 1 et seq., and by the California Arbitration Act, Cal. Code Civ. Proc. § 1281 et seq., where applicable.

14. Small-Claims Carve-Out

Either party may bring a qualifying claim in the Small Claims Division of the Superior Court of California for the County of Los Angeles instead of arbitration, provided the claim is within the small-claims jurisdictional limit and proceeds only on an individual basis.

15. Jury-Trial Waiver

TO THE FULLEST EXTENT PERMITTED BY LAW, EACH PARTY WAIVES ANY RIGHT TO A TRIAL BY JURY IN ANY ACTION OR PROCEEDING ARISING OUT OF OR RELATED TO THESE TERMS OR THE SITE.

16. Statute of Limitations

Any cause of action you may have arising out of or related to the Site or these Terms must be filed within one (1) year after the cause of action accrues, or it is permanently barred, except where a shorter period is specified by law or where the law prohibits shortening the statutory period.

17. Governing Law and Venue

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws principles. Subject to Section 13 (Arbitration), the exclusive venue for any judicial proceeding is the state and federal courts located in Los Angeles County, California, and you consent to personal jurisdiction in those courts.

18. Changes

We may update these Terms from time to time. We will revise the “Last updated” date at the top of the page. Material changes will be announced on the Site for at least thirty (30) days before they take effect, and where you have provided an email address we will notify you. Continued use of the Site after a change takes effect constitutes acceptance of the updated Terms.

19. Termination

We may suspend or terminate your access to the Site at any time, with or without cause, with or without notice. You may stop using the Site at any time. Sections that by their nature should survive termination will survive.

20. Severability and No Waiver

If any provision of these Terms is held unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will remain in full effect. Failure to enforce any provision is not a waiver of our right to enforce it later.

21. Entire Agreement

These Terms, together with our Privacy Policy, Cookie Policy, Acceptable Use Policy, and any other policies referenced on the Site, are the entire agreement between you and Short Stay in LA about your use of the Site, and they supersede all prior or contemporaneous understandings on that subject.

22. Survival

Sections 5 (User Content license), 6 (Intellectual Property), 10 (Disclaimer of Warranties), 11 (Limitation of Liability), 12 (Indemnification), 13 (Arbitration and Class-Action Waiver), 15 (Jury-Trial Waiver), 16 (Statute of Limitations), 17 (Governing Law), and 20 (Severability) survive any termination of these Terms.
