1. Our Policy
Short Stay in LA responds to clear notices of alleged copyright infringement in compliance with the Digital Millennium Copyright Act, 17 U.S.C. § 512. Our designated agent registration with the U.S. Copyright Office is pending; once registered we will update the agent block below.
2. How to Submit a Notice
To be effective under 17 U.S.C. § 512(c)(3), your notice must include substantially all of the following elements. Missing elements can invalidate the notice.
- a physical or electronic signature of the owner, or a person authorized to act on behalf of the owner, of the exclusive right allegedly infringed;
- identification of the copyrighted work claimed to have been infringed (or, if multiple works are at issue at a single online site, a representative list of those works);
- identification of the material that is claimed to be infringing or to be the subject of infringing activity, with information reasonably sufficient to permit us to locate the material (a direct URL is best);
- information reasonably sufficient to permit us to contact you, including an address, telephone number, and email address;
- a statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law;
- a statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
Send the notice to legal@shortstayinla.com with the subject line “DMCA Takedown Notice.”
3. How to Submit a Counter-Notice
If material you posted was removed in response to a DMCA notice and you believe the removal was the result of mistake or misidentification, you may submit a counter-notice under 17 U.S.C. § 512(g). To be effective, your counter-notice must include:
- your physical or electronic signature;
- identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared before it was removed or disabled;
- a statement under penalty of perjury that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification;
- your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located, or, if your address is outside of the United States, for the federal district court for the Central District of California, and that you will accept service of process from the person who provided the original notification or an agent of that person.
Send counter-notices to legal@shortstayinla.com with the subject line “DMCA Counter-Notice.”
